How to Prepare for the 2025 NSW Strata Law Changes

From 27 October 2025, a suite of new NSW strata law reforms will come into effect, changing how owners corporations, committees and building managers operate. These changes are aimed at improving fairness, accountability and transparency in strata living.

1. Financial Hardship Support for Owners

Every strata levy notice will need to include a Financial Hardship Information Statement. This statement explains support options available to owners who may be struggling to pay levies, and translated versions are available in ten languages.

2. Fairer Debt Repayment and Payment Plans

Committees must consider any owner’s request for a payment plan, using the new standard NSW Fair Trading form. Payment plans can be refused only if accepting them would leave the scheme’s funds insufficient.
Requests must be replied to within 28 days, and no additional fees can be charged for submitting one. While a payment plan is in place, debt recovery cannot proceed, giving owners a fair chance to catch up.
When repayments are made, funds must now be applied to the oldest overdue levies first, then to interest, and finally to recovery costs.

3. Reinforcing the Duty to Repair and Maintain Common Property

Owners corporations must continue to uphold their obligation to repair and maintain common property, but NSW Fair Trading will now have expanded enforcement powers. These include issuing compliance notices, requiring documentation, or entering enforceable undertakings where necessary.
Schemes are encouraged to complete a Strata Building Health Check to assess their current condition and maintenance readiness.

4. Strengthened Duties for Building Managers

Building managers will have clearer legal duties to act in the best interests of the owners corporation and exercise due diligence in matters of safety, maintenance and repairs. They must also disclose any financial benefits or relationships that could present a conflict of interest.

5. Easier Path to Change or End Management Agreements

If a strata or building manager breaches the law or fails to act appropriately, the owners corporation can apply to NCAT to terminate or vary the agreement.
Preparing Your Scheme
Owners corporations and committees should:

  • Review levy notice templates and ensure the hardship statement will be included from 27 October 2025.
  • Familiarise themselves with the new payment plan request process.
  • Ensure repair and maintenance programs are up to date and compliant.
  • Discuss the reforms with their strata and building managers to ensure everyone is aligned.
